Terms of Use
These Terms of Use ("Terms") are a binding agreement between you and Trotbee Private Limited, doing business as Fenmo AI ("Fenmo," "we," "us," or "our"). They govern your use of fenmo.ai and any other website where we display these Terms (each, a "Site"). By accessing or using a Site, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site.
These Terms apply only to the public website. Access to Fenmo AI's software-as-a-service platform, applications, and subscription services ("Subscription Services") is governed by a separate Master Subscription Agreement. We may update these Terms at any time; your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
1. Use of the Site
Permitted Use
You may use the Site and its content — including text, images, graphics, and other materials (collectively, "Content") — for your personal, non-commercial purposes and to learn about Fenmo AI and the products, services, and opportunities we offer.
Prohibited Conduct
When using the Site, you agree not to:
- Violate any applicable law, regulation, or these Terms
- Copy, modify, reverse-engineer, or create derivative works from the Site or its Content
- Sell, sublicense, distribute, or commercially exploit the Content or any part of the Site
- Transmit harmful or malicious code, or any offensive, defamatory, or fraudulent material
- Use automated systems (bots, scrapers, spiders) to access the Site
- Attempt to gain unauthorized access to the Site or interfere with its operation
- Mirror or frame the Site on any other website
If we determine that you have violated these Terms, we reserve the right to restrict or terminate your access to the Site.
2. Accounts
Certain features of the Site may require you to create an account. If you do, you agree that you are at least 18 years old, that the information you provide is accurate, and that you will comply with all applicable laws and any community guidelines we publish. You are responsible for keeping your credentials confidential and may not share your account with others. If you believe your account has been compromised, contact us immediately at compliancerequests@fenmo.ai.
We may limit account features, edit or remove your content, or restrict or suspend your account at our discretion. Either you or we may close your account at any time. Personal information associated with your account is handled in accordance with our Privacy Policy.
3. Intellectual Property
The Site and all Content — including its design, layout, text, graphics, and underlying technology — are owned by Fenmo AI or its licensors and are protected by copyright, trademark, trade dress, and other intellectual property laws. No right, title, or interest in the Site or Content is transferred to you. You may not reproduce, distribute, modify, or create derivative works from any Content except as expressly permitted on the Site.
The Fenmo AI name, logos, and marks are trademarks of Fenmo AI. You do not receive any license to use them. Any feedback, suggestions, or comments you provide about the Site may be used by Fenmo AI without obligation or compensation to you.
4. Materials You Submit
If the Site allows you to post or submit content ("Materials"), you represent and warrant that you have all necessary rights, consents, and authorizations to submit those Materials, and that they do not infringe any third party's intellectual property, privacy, or publicity rights. You grant Fenmo AI a non-exclusive, worldwide, royalty-free license to display, reproduce, and distribute those Materials in connection with the Site.
You agree that your Materials will not contain false, misleading, threatening, defamatory, obscene, or otherwise unlawful content. We reserve the right to edit or remove any Materials at our sole discretion.
5. Third-Party Links
The Site may contain links to third-party websites for your convenience. These links do not imply endorsement by Fenmo AI. We are not responsible for the content, availability, or privacy practices of linked websites, and you access them at your own risk.
6. Disclaimers & Limitation of Liability
Disclaimer of Warranties. The Site and all Content are provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Site will be uninterrupted, secure, or error-free, or that any Content is accurate or complete.
Limitation of Liability. To the maximum extent permitted by applicable law, Fenmo AI and its affiliates, officers, directors, employees, agents, service providers, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, revenue, or profits, arising out of or connected with your use of the Site or Content, regardless of the theory of liability.
Liability Cap. If Fenmo AI is found liable to you for any reason, our total aggregate liability shall not exceed one hundred US dollars (US $100.00). Some jurisdictions do not allow certain limitations of liability, so these limitations may not apply to you in full.
7. Indemnification
You agree to indemnify, defend, and hold harmless Fenmo AI and its officers, directors, employees, agents, and affiliates from and against any claims, losses, liabilities, damages, costs, and expenses (including reasonable legal fees) arising from your use of the Site, your Materials, or any violation of these Terms. We reserve the right to participate in the defense of any such claim at our expense. You may not settle any claim without our prior written consent.
8. Copyright Notices
If you believe that any material on the Site infringes your copyright, please send a written notice to legal@fenmo.ai including: a description of the copyrighted work, identification of the allegedly infringing material and its location on the Site, your contact information, a statement of good-faith belief that the use is unauthorized, and a statement under penalty of perjury that your notice is accurate and that you are authorized to act on behalf of the copyright owner.
If you believe a copyright notice was submitted against you in error, you may send a counter-notice to the same address with your identification, a description of the removed material, a statement of good-faith belief that the removal was a mistake, and your consent to the jurisdiction of the applicable courts.
9. General Provisions
Entire Agreement. These Terms, together with the Privacy Policy, constitute the entire agreement between you and Fenmo AI regarding your use of the Site.
Severability. If any provision of these Terms is found to be invalid or unenforceable, it shall be enforced to the maximum extent possible, and the remaining provisions shall remain in full effect.
No Waiver. Our failure to enforce any provision of these Terms shall not constitute a waiver of that or any other provision.
Errors. The Content may contain typographical errors or inaccuracies. We reserve the right to correct errors and update Content at any time without prior notice.
Governing Law & Jurisdiction. These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Bengaluru, Karnataka, India.
